DEFINITIONS

  • 'EasyMaths', 'we', 'us', and 'the company': Refers to EasyMaths LTD, including any affiliated entities, subsidiaries, or contractors providing services on behalf of EasyMaths.
  • 'The User': Refers to any individual, parent, guardian, or entity registering with and utilizing EasyMaths' services. This includes Students, parents/guardians acting on behalf of minors, and third parties responsible for arranging or paying for services.
  • 'The Tutor': Refers to any individual providing educational instruction, guidance, mentorship, or consultation as part of the tutoring services offered via the EasyMaths platform. Tutors may be self-employed contractors, freelancers, or independent business owners.
  • 'The Student': Refers to the individual receiving tuition services from the Tutor. In cases where the Student is under the age of 18, the responsible parent, guardian, or User is legally obligated to act on behalf of the Student.
  • 'The Project': Refers to the entire scope of the tutoring or educational arrangement between the Tutor and Student, facilitated by EasyMaths, including individual sessions, ongoing mentorship, or one-time consultations.
  • 'Session': Refers to a single, continuous instance of tuition, whether conducted in person, over the phone, or via electronic means (e.g., video conferencing, online chat). Sessions may vary in duration and are subject to mutual agreement between the Tutor and Student.
  • 'The Platform': Refers to the digital platform provided by EasyMaths, which facilitates the connection between Tutors and Students. This platform includes any website, application, or software utilized to provide tutoring services and process payments.

GOVERNING LAW

This agreement, and any disputes, claims, or proceedings arising out of or relating to this agreement, shall be governed by and construed in accordance with the laws of England and Wales. Both the User and EasyMaths agree that any legal disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

INTRODUCTION

EasyMaths LTD operates as a service provider and intermediary, facilitating the matchmaking process between Tutors and Students. EasyMaths provides administrative and technical support to ensure a smooth, reliable, and secure tutoring arrangement, but does not directly manage or oversee the content of tuition provided. EasyMaths also offers ongoing platform services, including payment processing and user support.

Users acknowledge that Tutors operate as independent contractors and that EasyMaths does not directly employ or oversee the actions of the Tutors. All communication and scheduling between Tutors and Students is facilitated via the platform, though EasyMaths reserves the right to intervene in cases of non-compliance with these Terms and Conditions.

ACCEPTANCE OF THESE TERMS

By using EasyMaths' services or the platform, the User agrees to these Terms and Conditions in full. Users acknowledge that continued use of EasyMaths' services constitutes their acceptance of any amendments or updates made to the Terms. EasyMaths reserves the right to update, modify, or amend these Terms and Conditions at any time, with updates becoming effective immediately upon publication on the website.

Users are encouraged to review the Terms periodically to remain informed of any changes. EasyMaths will not be held liable for any misunderstandings arising from the User's failure to read or comprehend the most current version of these Terms.

ELIGIBILITY

Users must be at least 18 years of age to register for and use EasyMaths' services independently. Students under the age of 18 must have the consent and supervision of a parent, legal guardian, or responsible adult aged 18 or older who will be considered the User for purposes of this agreement. The User is responsible for ensuring that all communications, payments, and interactions with EasyMaths and the Tutor are conducted lawfully.

EasyMaths reserves the right to verify the identity and age of Users, and may request proof of age or identity documentation when necessary. EasyMaths may, at its sole discretion, terminate services or suspend an account if a User is found to be ineligible or providing false information.

USER OBLIGATIONS

  • Accuracy of Information: Users must provide truthful, accurate, and up-to-date information when registering for and using EasyMaths' services. This includes providing correct contact information, payment details, and any relevant academic or personal background information required to facilitate the tutoring process.
  • Compliance with Laws: Users are required to comply with all applicable laws and regulations when utilizing EasyMaths' services. This includes, but is not limited to, local, national, and international laws related to education, data protection, intellectual property, and contract law.
  • Ethical Conduct: Users agree to engage in ethical behaviour at all times when interacting with Tutors, Students, and other users on the platform. Users shall not engage in behaviour that disrupts the learning environment, causes harm to others, or violates the terms of service.

UNETHICAL PRACTICES

EasyMaths maintains a zero-tolerance policy toward unethical practices, including but not limited to:

  • Plagiarism: Users must not request or encourage the Tutor to complete assignments, exams, or other work on behalf of the Student unless specifically outlined as part of the tutoring arrangement.
  • Academic Misconduct: Users must not engage in or facilitate academic dishonesty, cheating, or fraudulent activity in relation to educational institutions, exams, or certifications. EasyMaths reserves the right to terminate services if a User or Student is found to be participating in academic misconduct, with no entitlement to a refund.
  • Intellectual Property Violations: Users must respect the intellectual property rights of Tutors and EasyMaths. Any material provided during the course of tuition, including lesson plans, resources, or assignments, may not be redistributed, sold, or reproduced without the prior written consent of the rightful owner.

EasyMaths reserves the right to withdraw services from any User found to be engaging in unethical behaviour without providing any refunds. Additionally, any violations of law will be reported to the relevant authorities where necessary.

DISCRIMINATION

EasyMaths operates in accordance with the Equality Act 2010 and is committed to fostering an inclusive environment for all users. We do not tolerate discrimination or harassment on the basis of race, gender, ethnicity, sexual orientation, religion, age, disability, or other protected characteristics. Any User found engaging in discriminatory behaviour will have their account terminated immediately.

Users who feel they have been subjected to unfair treatment or discrimination while using EasyMaths' services are encouraged to contact us at info@easymaths.com, where we will investigate the matter thoroughly.

TUITION FEES AND CHARGES

  • TUITION FEES AND CHARGESTuition Fees: EasyMaths offers three fixed tuition plans: once a week, twice a week, or three times a week. The fees for these plans are standardised. While the plans may change over time, there are no hidden charges. We may also offer in-person tuition, which will have its own pricing and payment system separate from the current online plans.

    Weekly Direct Debit Payments: All tuition fees for online tutoring are collected via weekly direct debit payments, ensuring a smooth and transparent process for both Tutors and Users.

    Additional Fees: If additional services (e.g., extra session preparation, extended feedback, or marking) are needed outside the agreed tuition plan, these services may incur extra charges. These fees will be agreed upon in advance and included in the following week's direct debit payment.

BILLING AND PAYMENTS

  • Invoicing: After each completed session, invoices are automatically generated via the EasyMaths platform. Users must review and confirm the invoice details before payments are processed.
  • Payment Methods: All payments are processed securely via a third-party payment provider, such as Stripe, using credit or debit cards. Users authorize EasyMaths to process automatic payments according to the invoice details provided.
  • Late Payments: Payments are due within three days of invoice issuance. Failure to pay within this period may result in service suspension until the payment is made. Repeated late payments may lead to account suspension or termination of services.

REFUNDS

  • Tutor Discretion: Refunds for tutoring services are issued at the sole discretion of the Tutor. Any refund requests should be made directly to the Tutor, and EasyMaths will not intervene unless an ethical violation or misconduct has occurred.
  • Platform Fees: Platform usage fees paid to EasyMaths are non-refundable unless a proven technical issue or platform error occurred that prevented the completion of a session.

CANCELLATION AND ABSENCE

  • Session Cancellation: Users must notify the Tutor and EasyMaths at least 24 hours in advance if they wish to cancel or reschedule a session. Failure to provide adequate notice may result in a charge of up to 50% of the session fee.
  • Absence Without Notice: If a User or Student fails to attend a session without prior notice, the full session fee may be charged.
  • Membership Cancellation: Cancellation of membership or long-term agreements requires a formal written request via EasyMaths’ "Contact Us" page or by email. EasyMaths reserves up to 14 days to process any such cancellation requests.

LIABILITY AND DAMAGES

EasyMaths is not responsible for the outcomes or results of tutoring services. Users acknowledge that academic success depends on the Student's personal efforts, and that the Tutor provides only instructional guidance. EasyMaths cannot be held liable for any indirect, consequential, or incidental damages, including lost opportunities, missed academic goals, or professional outcomes.

TERMINATION OF TUITION

Both the Student and Tutor may terminate the tuition at any time. All scheduled sessions must be cancelled in accordance with the cancellation policy by letting any one of our staff know including their assigned tutors. Users remain liable for any outstanding payments related to previously scheduled sessions at the time of termination.

DATA PROTECTION AND PRIVACY

EasyMaths is committed to safeguarding the privacy of its users in compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. We only collect and process personal data necessary for the functioning of our platform and services. Please refer to our Privacy Policy for further details on how we handle personal information.

NON-SOLICITATION

Users agree not to engage Tutors directly, bypassing EasyMaths, for any services within six months of the termination of this agreement. Should a User or Tutor arrange tuition privately without the knowledge of EasyMaths, both parties may be subject to penalties, including fines equivalent to six months of platform fees or legal action.

TUTOR STATUS

Tutors operating through EasyMaths are self-employed individuals and independent contractors. They are responsible for their own schedules, methods of instruction, and compliance with relevant tax obligations. EasyMaths does not manage or control the delivery of services, and Tutors are not considered employees of EasyMaths.

CONFIDENTIALITY

All users agree to maintain the confidentiality of information obtained during the course of tuition, including personal information, academic materials, and proprietary content. Confidential information shall not be disclosed to any third party, except as required by law.

INTELLECTUAL PROPERTY

All content provided through the EasyMaths platform, including text, graphics, software, and other materials, remains the intellectual property of EasyMaths and its licensors. Users may not reproduce, modify, or distribute content without the express written consent of EasyMaths.

FORCE MAJEURE

At EasyMaths, we always strive to provide uninterrupted services. However, there may be rare situations beyond our control—such as natural disasters, strikes, or internet outages—that could impact our ability to deliver lessons as scheduled. While we will do our best to keep you informed, in such cases, services may be temporarily paused or canceled without us being held responsible. We appreciate your understanding and patience during these unforeseen events.

SEVERABILITY

If any provision of these Terms is deemed unlawful, invalid, or unenforceable, that provision shall be removed, and the remaining provisions will continue to be valid and enforceable.

ENTIRE AGREEMENT

These Terms and Conditions, along with any other legal notices or agreements published by EasyMaths, represent the entire agreement between the User and EasyMaths. Any previous understandings or agreements are superseded by this document.
